Intermediary Conditions of Pure Surf Camps GmbH

These conditions govern the legal relationship between Pure Surf Camps GmbH and the customer, even if travels, or individual tourism services, are provided by variously named companies.

"In advance, a right of withdrawal, in accordance with §§ 312 ff. BGB exists for travel contracts only if these contracts have been concluded outside of business premises (eg at your home). Even if this is the case, only if the corresponding oral negotiations are not carried out on a prior order by you, as a consumer. Otherwise, the statutory rescission and termination provisions apply.

Agent contract by Pure Surf Camps GmbH / Conditions of the mediated contract

1.1
If Pure Surf Camps GmbH, expressly procures travel offers, or individual tourism services from other providers (eg flights, car rental, etc.), Pure Surf Camps GmbH shall only owe the customer proper mediation, not the mediated service itself (business agreement pursuant to §§ 675, 631 ff BGB). The conditions of the mediated contract, and its content, shall be governed by the relevant statutory provisions and, if applicable, according to the terms of the respective contracting party insofar as these are included as contract components.

1.2
The liability of Pure Surf Camps GmbH from the broker agreement shall be limited to triple the price of the services provided, this is for damages that are not corporate. If Pure Surf Camps GmbH causes damage intentionally, or through gross negligence, Pure Surf Camps GmbH is of course liable without limitation.

2. Data protection / Executing Air Travel provider

2.1
The data collected of the travellers during registration are used solely for the purposes of the journey, and for customer support. The right to object, under Section 28 (4) of the Federal Data Protection Act, is possible via a short communication to the address given at the end of this GTC.

2.2
EC Regulation No 2111 of 14.12.05, requires tour operators, travel agents and transport contractors to inform travellers of the identity of each carrier, as soon as it is established. If this is not the case at the time of booking, the most likely carrier must be indicated. If the airline changes after booking, the customer must be informed without delay.

2.3
The current list of air carriers against which an operating disagreement in the EU (blacklist) has been issued can be found on the ec.europa.eu/transport/air-ban/list_en.htm website.

3. Damage to, or loss of luggage

In the case of luggage being lost, or damaged, you must report it immediately to the carrier, as international agreements, and legal provisions, contain additional exclusion periods (in addition to those mentioned in these conditions). The carrier is obligated to issue a written confirmation, referred to as a "Loss Report". Customers are advised to review the receipt of this document, and keep it carefully.

4. Passport, Visa & Health Regulations

4.1
The information provided by Pure Surf Camps GmbH as an intermediary regarding recommended health, Visa & Passport regulations refers to the current stand, for EU citizens. Pure Surf Camps GmbH does not take into consideration any personal circumstances, as long as there was no special information supplied before booking.

4.2
It is expressly pointed out that there is always the possibility of a subsequent amendment of these health, Visa & Passport regulations. Pure Surf Camps GmbH will make every effort to inform the traveller of any changes as soon as possible. However, travellers are advised to follow the news & media hthemselves, in order to be able to adapt to changes at an early stage.

4.3
The traveller should be informed in good time about possible infections and vaccination protection available as well as other prophylaxis measures. Where appropriate, medical advice on thrombosis and other health risks should be sought. General information can be provided by health authorities, experienced doctors, the Foreign Travel Advice Centre & the World Health Organization.

4.4
If difficulties arise for the traveller due to the aforementioned regulations, which prevent, or impair his or her participation in the journey, the customer is not entitled to cancel the contract free of charge. The mentioned difficulties are not attributable to Pure Surf Camps GmbH for its mediating services. Reciprocal claims in the event of liable behaviour on the part of Pure Surf Camps remain unaffected, as long as the limitation of liability does not interfere with these travel conditions.

5. Insurance

Pure Surf Camps GmbH, as an intermediary, recommends obtaining verified travel insurance that covers cancellation & health insurance, in case of an accident or illness before or during your trip. We recommend HanseMerkur Reiseversicherung AG, Siegfried-Wedells-Platz 1, 20354 Hamburg.
